Immigration Appeals, Administrative Reviews or Judicial Reviews

Appeals & judicial review-Letter before Claims

If you have made an application to the UK Border Agency and it is refused, you might be able to appeal that decision.

Whilst it is not possible to appeal against every refusal, it may be possible to seek an administrative or judicial review of that decision. Judicial review is the procedure by which you can seek to challenge the decision, action or failure to act of a public body exercising a public law function.

Appeals and reviews of decisions made by the UK Border Agency can be complex and seeking the advice and assistance of an immigration specialist and advocate is highly recommended.

Liyon Legal Ltd  offer a service designed to advise and practically assist you with any appeal or review. We can advise as to the merits of your case right through to lodging an appeal and represent you at a hearing.

How to apply

Need at least a paragraph explaining each

  • Premium Applications

Immigration applications to UK Visas and Immigration (UKVI, formerly the UKBA) can be made by the Postal or the Premium service. Given that the typical waiting time for a Postal decision is one to six months, and the fact that your passport and other important documents will be unavailable throughout this time, many people find that it is preferable to apply using the Premium route.

Premium appointments are also known as Same Day appointments or one day service, In Person appointments, or Fast Track appointments. Premium appointments allow you to receive your decision on the same day. Your passports and all supportive documents are also returned to you on the same day. The Biometric Residence Permit (BRP) is then issued within 10 working days.

Liyon Legal Ltd: Premium service

Liyon Legal Ltd can book an appointment on your behalf for a Premium visa application. Our office is located in Barking, Essex, UK, which provides easy access to the Home Office East Croydon Premium Service Centre (PSC). We have an excellent and long standing relationship with the staff at  all the PSC centres around the UK . All of our premium clients are accompanied and assisted by one of our experienced, OISC-registered advisers on the day of the appointment any UK Premium Service Centres (it may include Sheffield, Liverpool, Birmingham, or Croydon (London). Do get in touch.

Although our office is based in Barking Essex, we are proud to welcome clients from across the UK, including many from Sheffield and Southern England, Birmingham and the Midlands, and Belfast and Northern Ireland. Before the day of your appointment we do not need to see you in person unless you wish to do so, but instead can communicate with you about your application by phone, email, Skype and postal courier, as is most convenient for you. On the day of your appointment, you will have to attend your chosen Premium Service Centre to provide biometrics.

Premium appointments are available for:

  • Tier 2 for employees (this replaced Work Permits)
  • Tier 4 (student visas)
  • Tier 5 (temporary workers)
  • Indefinite Leave to Remain (ILR)/ Settlement
  • Further Leave to Remain (FLR(M), FLR(O))
  • Marriage/ Partner/ Fiancé(e) visa
  • Points Based System (PBS) Dependant

How to book your own Premium appointment

If you don’t require assistance in your visa application process or on the day of the appointment, then you may wish to book your own Premium appointment directly with the UKVI. In this case, you should visit the UKVI premium appointment page. You will need to book an appointment at one of the seven Public Service Centres (PSCs) in the UK. You can choose which centre to apply to – it does not have to be the nearest one to you. The PSCs are located at:

  • Croydon (South London)
  • Solihull (Birmingham)
  • Glasgow (Scotland)
  • Liverpool
  • Sheffield
  • Belfast (Northern Ireland)
  • Cardiff (Wales)

If you have already booked your own Premium appointment, but now in a need of assistance or support, then we are able to help. In this case we would answer the questions you may have, complete the application form(s), carry out a full document check, and attend the Premium Service Centre on the day with you, as your nominated/instructed Representative.

Super Premium service

As an alternative to regular Postal or Premium applications, you are able to use the Home Office’s ‘Super Premium’ visa application service. The advantage of this service is that Home Office’s case workers visit you at a time of your choosing. As the Home Office comes to you, you therefore save the time that you would have had to spend travelling to, and waiting at, a Premium Service Centre.

An additional advantage is that certain types of application are available under the Super Premium service, even though not under the regular Premium service: for example, Tier 1 Investor.

Liyon Legal ltd can assist with this process, including arrangement of your Super Premium appointment, and in person assistance on the day of the application – wherever you are located in the UK.

Making a postal application

You can find the correct form for your application on the Home Office’s Apply Online web page. After submitting your application, you will receive an Acknowledgement Letter from the Home Office, and two to four weeks after that, a Biometrics Invitation Letter.

Postal applications take between three weeks to over six months to be resolved, dependent on the individual application. The more information on current processing times can be found on Home Office Website.

Providing Biometrics

Migrants making a postal application can provide their biometrics approved post Offices across the UK, at a cost of £19.20 per person. This needs to be done within 15 working days of receiving your Biometrics Invitation Letter. (Or 2 days for Priority Postal.) You do not need to book an appointment to use this service. You must, however, take the bar-coded sheet that the Home Office sent to you: this bar-code will allow your biometrics to be matched with your application on the online system.

When you arrive at your chosen Post Office, a member of staff will assist you:

Alternatives: Premium and Priority Postal

Considering the delays when posting an application, considering the fact that your passport and other important documents will be unavailable throughout this delay, many people decide that it is better to apply in person. See our guide to Premium applications for an overview.

A;llternatively, if you are applying for Tier 2 (only), you are able to make use of the Priority Postal service. Using the Priority Postal service, you are guaranteed a decision within 10 working days
